Jeffrey F. Montgomery

Jeffrey F. Montgomery, Chair of CMAM’s Real Estate Practice, focuses his practice on commercial real estate, company, and finance law. He has over thirty years of experience advising developers, investors and lenders in project development, joint ventures, debt and equity offerings, credit transactions, secured lending and leasing in both economic growth and workout environments.

Jeff represents and serves as outside general counsel to several privately held major retail, multifamily and multiuse developers, including local, regional, and foreign based funds and organizations, and he has provided expert advice on joint venture disputes, property management and in most major areas of real estate practice, from mining interests to usufructs.

His original training was as an international transactions, mergers, and acquisitions attorney with a major law firm, which training provided him with a strong understanding of corporate and company structures, transactions, and an ability to adapt to diverse environments with creativity. He maintains an interest in mergers and acquisitions, particularly when it involves real estate-related assets. At this point in his commercial real estate career, there is little that Jeff has not seen, and he enjoys helping his clients with whatever issues they present.

Selected Matters

  • Acted as outside general counsel for local, national, and international retail and multiuse developers of grocery anchored shopping centers, power centers, lifestyle centers, and regional malls.

  • Advised developers in connection with master developments of multiphase developments.

  • Advised U.S. development and construction subsidiary of a major international company on its investments in and financing and development through its own subsidiaries of residential, industrial, student housing and major project developments.

  • Represented conventional lenders and hard money lenders in secured and unsecured loan transactions.

  • Provided advice for complex debt and equity structures and public private partnerships for the development and redevelopment of a variety of real estate projects, from a medical office campus in the Atlanta, Georgia metropolitan area, to cities or portions of cities such as Sunnyvale (CA), Sacramento (CA) and Fayetteville (GA), to a listed property across from the Tower of London.

  • Supervision of litigation related to all aspects of joint ventures, financing, development, and land use.

  • Negotiation of contracts related to development, construction, and management of real property.

  • General company representation.
